1. Services Provided

Santa.ai offers AI-generated messages, entertainment experiences, virtual Santa interactions, and digital content. All outputs are for entertainment purposes only.

2. User Responsibilities

You agree not to:

  • Misuse the Service
  • Violate intellectual property rights
  • Attempt unauthorized access to any system
  • Use the Service to harass, exploit, or harm any person

3. Payments & Refunds

Purchases must be paid at the time of order. All sales are final unless expressly stated otherwise.

4. Intellectual Property

All content, branding, software, and AI outputs are the property of Voicebot Factory Inc. You may not replicate or commercialize the Service without permission.

5. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE.” We do not guarantee:

  • Accuracy of AI outputs
  • Error-free operation
  • Uninterrupted service uptime

AI content may occasionally produce incorrect or unexpected results.

6. LIMITED LIABILITY CLAUSE

To the fullest extent permitted by law:

A. Liability Is Limited

Voicebot Factory Inc. shall not be liable for:

  • Indirect, incidental, special, punitive, exemplary, or consequential damages
  • Lost profits, lost data, business interruptions
  • Emotional or psychological reliance, misunderstanding, or misinterpretation of AI-generated content

B. Maximum Recoverable Damages

Total liability is strictly limited to the total amount the customer paid to the Company for the Service during the previous 12 months.

If you paid nothing, liability is $0.

C. No Punitive Damages

You agree that punitive damages are not recoverable under any circumstances.

7. Indemnification

You agree to indemnify and hold harmless Voicebot Factory Inc. from claims arising from:

  • Your misuse of the Service
  • Your violation of these Terms
  • Your violation of another person’s rights

8. Governing Law

These Terms are governed exclusively by the laws of the Commonwealth of Pennsylvania.

9. MEDIATION & ARBITRATION CLAUSE (Pittsburgh, PA)

A. Mandatory Mediation

Before filing any legal claim, you agree to participate in good-faith mediation in Pittsburgh, Pennsylvania. Costs are split equally.

B. Binding Arbitration

If mediation fails after 45 days, disputes shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) in Pittsburgh.

C. No Class Actions

You waive any right to:

  • Class actions
  • Class arbitrations
  • Collective proceedings

All disputes must be brought individually.

D. Injunctive Exceptions

Either party may seek temporary injunctive relief in Pennsylvania courts.

10. Termination

We may suspend or terminate your access for:

  • Violation of Terms
  • Fraudulent conduct
  • Abuse or misuse of the Service

11. Updates to Terms

We may modify these Terms at any time. Your continued use of the Service constitutes acceptance of updates.

  • AI models and outputs

California & Child Privacy Addendum

This California & Child Privacy Addendum supplements the Santa.ai Privacy Policy and applies to:

  • California Residents under the CCPA/CPRA, including minors
  • Children under 13, in compliance with COPPA
  • Parents/Guardians supervising their children’s use of Santa.ai

If you live in California or if your child uses Santa.ai, these additional rights and rules apply.

1. Children’s Privacy (Under Age 18)

Ages 13–18

Teens ages 13–18 may use Santa.ai with parental or guardian permission. We do not knowingly sell or share teen data for advertising purposes.

Children Under 13

In compliance with COPPA, Santa.ai:

  • Does not knowingly collect personal information directly from children under 13 without verifiable parental consent
  • Requires a parent or guardian to create or supervise the account
  • May collect limited information necessary to provide the Santa interaction (e.g., “first name,” “wish list message”), but only when provided by a parent or guardian

We do not require any child to disclose more information than is reasonably necessary.

Parents may request deletion of all child data at any time.

2. What Information We Collect From Minors

We may collect, only as provided by a parent/guardian:
